Terms of service

Clear expectations for a very personal product.

These Terms of Service are an agreement between you and Dear Chorus LLC (“Dear Chorus,” “we,” “us,” or “our”). By placing an order, you confirm that you are at least 18, can enter this agreement, and accept the terms in effect on the order date. Effective September 7, 2026.

01

The service and your order

Dear Chorus creates an original custom song and the digital deliverables listed for the package you select. You agree to provide accurate contact information, review the order summary, and pay the displayed one-time price and applicable taxes. An order is accepted when payment succeeds; we may decline or refund an order we cannot safely or lawfully fulfill.

02

Your materials and permission to use them

You retain rights in the stories, recordings, images, phrases, and other materials you provide. You grant Dear Chorus and its service providers a limited, non-exclusive license to store, reproduce, transcribe, adapt, and otherwise process those materials only as reasonably necessary to create, deliver, support, and protect your order. You confirm that you have the right to submit them and that doing so does not violate privacy, publicity, copyright, trademark, or other rights.

03

Accuracy, consent, and sensitive details

You are responsible for checking names, dates, relationships, pronunciations, quotations, and other facts before checkout and again during any revision. Do not submit confidential information you do not want included, full financial or government identifiers, medical records, or another person’s private recording without appropriate permission.

04

Creative process

Custom music involves artistic judgment. You may request a mood, genre, vocal direction, and details, but an exact melody, performance, emotional reaction, or resemblance to a reference cannot be guaranteed. Technology may assist transcription, organization, and creative exploration; a person reviews the production package and final delivery. We may refuse requests that imitate a living artist, impersonate a real person, infringe rights, deceive, harass, exploit, or violate law.

05

Delivery

Delivery is made through a private page and the files included in your package. The stated 24–48 hour window is a good-faith target beginning after successful payment and a sufficiently complete submission, not a guarantee. If important details are missing or a delay becomes material, we may contact you and the timeline may change. Event use is at your risk; download and test all files in advance.

06

Revisions, cancellations, and refunds

Each order includes one consolidated revision request within the scope and timing described in the Refund and Revision Policy. Technical corrections do not consume that revision. Cancellations and refunds are governed by that policy and applicable law. A new recipient, story, concept, or substantially different musical direction may require a new order.

07

Your use of the delivered song

After full payment, Dear Chorus grants you a perpetual, worldwide, non-exclusive license to download, keep, play, copy, and share the delivered materials for personal, non-commercial use, including private gifts and personal social posts. Commercial advertising, paid distribution, monetization, synchronization, sublicensing, resale, or use on behalf of a business requires a separate written license. Rights in your pre-existing materials remain yours; third-party materials remain subject to their owners’ rights.

08

Ownership and creative rights

Dear Chorus retains its brand, website, process, templates, and any rights it holds in original production elements, subject to the personal-use license above. Nothing in these terms promises that every element of a technology-assisted output is eligible for copyright protection, and these terms do not transfer rights that Dear Chorus does not own.

09

Service availability and liability

We work to keep private pages and downloads available, but temporary interruptions may occur. To the fullest extent permitted by law, the service is provided without implied warranties beyond non-waivable consumer rights, and Dear Chorus is not liable for indirect, incidental, special, or consequential losses. Our aggregate liability for a claim related to an order will not exceed the amount paid for that order. These limits do not apply where prohibited by law.

10

Changes, severability, and contact

We may update these terms prospectively by posting a revised effective date; the version accepted when you order governs that order. If a provision is unenforceable, the remaining terms continue to apply. These terms, the Privacy Policy, Refund and Revision Policy, and the package description form the agreement for the order.
